First, hot news isn’t entirely legal. While the concept is still in its infancy, some courts have recognized it as a viable legal remedy. In NBA v. Motorola, a company accused another of stealing “hot news” by using its product. While the Second Circuit ultimately ruled that the plaintiff’s copyright claim failed, the concept of “hot news” may be alive and well in certain situations. Its application in the future of technology and publishing is likely to be important.

The concept of HOTnews first surfaced in the United States in 1918. The Supreme Court recognized it as a legal term in a case where the International News Service allegedly stole war reports from Associated Press reporters in Europe. The AP had sued the company, claiming that it had bribed its employees to steal the war reports. Currently, hot news is recognized in five states, and likely to be used only in rare instances. This definition depends on copyright laws.

The scope of the hot news exception is still hazy. The 1976 Act makes it harder to prove, as hot news is essentially a type of copyright. Although it is possible to sue a person or business for using an article or a photo that is in violation of the law, it is rare in practice. Copyright law prevents this, and the courts will generally apply the copyright law. But this doctrine does not prohibit the use of a copy of a piece of news if it was created by another person.
